This is the rental agreement. It is your responsibility to read through and understand this agreement before you rent out the equipment. You will be prompted to read through this during checkout.
EQUIPMENT HIRE AGREEMENT

2. Definitions

"Equipment": The items provided under this agreement, including but not limited to Night Vision Devices, Ops-Core Shroud, Wilcox G24 Mount, J-Arm, Bridge Mount, Lanyard, FMA Maritime Helmet, FMA Counterweight Pouch, Lanyards and Laser/Illumination Module.

"Total Loss": Any damage or incident resulting in irreparable harm to the Equipment or where the cost of repair exceeds the Equipment's current market value.

"Casualty Value": The Equipment’s market value at the end of the hire term or immediately before the occurrence of a Total Loss.

"Hire Period": The fixed period for which the Equipment is hired as stated in the confirmation provided to the Hirer.
- “Courier” means a reputable Courier organisation responsible for carrying the Goods to or from the Hirer as organised by JEC NVG.
- “Deposit” means any Deposit required by the JEC NVG in relation to the goods which is to be held as security by the Company.
3. Hire Term

Commencement: Begins upon receipt of full payment and dispatch or collection of Equipment.

Duration: As stated in the Hire Confirmation sent to the Hirer via email.

Extension: Only permitted by written agreement between the parties.

Termination: Upon return and full inspection of all hired Equipment in acceptable condition.
4. Hire Charges and Security Deposit

Hire Charges: Payable in full prior to release of Equipment, per the rates agreed at time of booking.

Security Deposit: £200.00, refundable upon safe return of Equipment. The Owner may deduct from the deposit to cover:

Any damage, cleaning, or missing accessories

Late return penalties
-
Any sums owed under clause 7 (loss/damage)

Non-payment: Failure to pay may result in cancellation or withholding of the Equipment.
- The Hirer will pay a security deposit of £200.00 (the "Deposit") before taking possession of the Equipment. The Owner will refund the Deposit to the Hirer at the end of the Term provided that the Hirer has performed all of the Hirer's obligations under this Agreement.
- By placing an order, you confirm that you are over 18 years old and have read and understood these terms and conditions and agree to be bound by them and to comply with all applicable laws, rules, and regulations.
5. Delivery and Collection

Delivery: Arranged by the Owner via tracked courier or collected in person. Risk passes to the Hirer upon delivery or collection. The Hirer shall accept delivery of the Equipment on the day the Courier first attempts to deliver. Where the Courier has attempted to deliver Equipment, but the Hirer has not been present to accept the delivery, the hire period shall remain as shown on the Order Confirmation.

Return: The Hirer is responsible for ensuring Equipment is securely packaged and returned via tracked, insured courier or in person by the agreed date.

Failure to Return: Considered theft and reported to authorities after 4 calendar days of non-return. If the Equipment is not available for collection, the Hirer will be charged a failed collection fee of £20 +VAT and will be charged for the extension of hire. In the event Equipment is not returned within 24 hours of the collection date and not withstanding Courier delays, the Hirer will be charged a fee equal to a full day’s commercial rental for each day the Equipment remains unreturned.
6. Use of Equipment
The Hirer shall:

Use the Equipment only for its intended purpose and in accordance with manufacturer guidance.

Not use the Equipment in direct sunlight, bright daylight, or in hazardous conditions that may cause damage.

Not loan, hire, or sublease the Equipment to any third party.

Ensure the Equipment is used only by persons over 18 years of age, trained and competent in its use.

Abide by all UK laws, including relevant laws regarding the possession and use of night vision or laser equipment.

Not transport the Equipment outside of the UK without express written permission from the Owner.
- The Hirer will use the Equipment in a good and careful manner and will comply with all of the manufacturer's requirements and recommendations respecting the Equipment and with any applicable law.

- The hirer will not use the Equipment during daylight as this may cause damage to the device.

- The hirer will not leave the equipment unattended at any time, the hirer will keep it in the locked box, in a secure location and only use the device after daylight hours.

- The Hirer will read all instructions on use, ensure relevant video demonstrations are watched and agree to email info@jecnvg.co.uk with any questions regarding use if they are not sure. Ignorance is no excuse.
7. Hirer’s Obligations

Take all reasonable precautions to protect the Equipment from theft, loss, or damage.

Immediately report any damage, defect, or malfunction to the Owner.

In case of theft or loss, notify local police within 24 hours and provide a crime reference number.

Allow access for inspection of Equipment upon request with reasonable notice.
-
Provide a valid photo ID (e.g., passport or driving licence) and proof of address prior to the commencement of hire.
8. Loss, Theft, and Damage
-
The Hirer bears full liability for all loss, theft, or damage occurring during the hire period, regardless of cause, unless proven to be the Owner’s fault.

In the event of Total Loss, the Hirer agrees to pay the full Casualty Value as determined by the Owner within 7 days.

Where damage is repairable, the Hirer agrees to pay reasonable repair costs including shipping and assessment fees.
-
Deliberate damage, unauthorised tampering, or negligent handling will void any insurance cover and the Hirer remains fully liable.
- Minor scuffs are acceptable, if the device is used properly and not used in bright light locations then the device will not receive any damage. People shining bright light, IR or visible lasers into the NVD will cause damage.
9. Insurance

Owner's Insurance: The Owner may carry insurance for the Equipment, but this does not release the Hirer from liability under this Agreement.

Unattended Equipment left unsecured

Use during unlawful activity

Damage from misuse or operation outside manufacturer’s guidelines

The Hirer remains responsible for any excess, uncovered claims, or costs not reimbursed by the Owner’s insurer.
- If the Equipment is lost or damaged, the Hirer will continue paying Rent, will provide the Owner with prompt written notice of such loss or damage and will, if the Equipment is repairable, put or cause the Equipment to be put in a state of good repair, appearance and condition. The Equipment is fully insured with the owner. Should there be a loss or damage the owner will take ownership of the security deposit and a claim will be made through the owners insurance company.

- Insurance Coverage is conditional on meeting certain security requirements: doors and windows must be locked, keys removed or stored in a locked safe, and any alarms must be activated. Coverage exclusions include shared hotel rooms, tents, unlocked or soft-top vehicles, and goods not out of sight.
10. Late Return and Non-Return

Late Return: A fee of £50.00 per day will be charged for each day the Equipment is overdue beyond the agreed return date.

Non-Return: If Equipment is not returned within 4 calendar days of the due date:

The Equipment will be deemed lost/stolen.

The Owner will retain the deposit.

Legal action and police reports will be pursued.

The Hirer will be liable for the full replacement cost.

11. Indemnity
The Hirer shall indemnify and hold harmless the Owner from any claims, demands, costs, losses, or liabilities arising from:

Personal injury or death resulting from the use or misuse of the Equipment.

Damage to third-party property.
-
Breach of law or regulation arising during the hire period.
-
Any unauthorised use of the Equipment.
- The Hirer shall pay all legal fees or costs incurred in connection with the enforcement of these terms and conditions or legal fees incurred in connection with any dispute or difference arising under this agreement that is resolved in favour of the Company.
12. Termination by Owner
The Owner may terminate this agreement immediately if:

The Hirer breaches any clause herein.

The Equipment is used unlawfully or irresponsibly.
-
The Owner has reasonable grounds to suspect risk to Equipment or third parties.
Upon termination, the Hirer must immediately return the Equipment.
13. Ownership
The Equipment remains at all times the sole property of the Owner. The Hirer obtains no ownership, interest, or lien over the Equipment.
14. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the English courts.
15. Entire Agreement
This document represents the entire agreement between the parties and supersedes all prior understandings, communications, or representations, whether oral or written.
NOTICE TO THE HIRER: This is a lease. You are not buying the Equipment (unless a for sale item)
16. Severability
If any clause or provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
17. Data Protection
The Owner will process all personal data in accordance with the UK GDPR and Data Protection Act 2018. Data will only be used for purposes related to this Agreement and will not be shared without lawful basis. GDPR Policy
18. Cancellation
- Where the Hirer is a consumer, they shall have the right to cancel an order by written notice up to 14 working days after receiving the Order confirmation email.
- All cancellations and amendments must be confirmed in writing.

Without prejudice to any other right or remedy available to the Company in the event of a cancellation of an Order by the Hirer, the Company reserves the right to make a cancellation charge in respect of Equipment as follows:
- More than 14 days before start period - £20 Admin fee
- Within 14 Days of dispatch date - £20 Admin fee +
- Within 4-14 Days of hire - 25% of hire
- Within 3 Days of hire - 30% of hire
- Within 2 Days of hire - 50% of hire
- Within 1 Days of dispatch - 80% of hire
- A 50% reduction of the cancellation fee can be applied if the value is taken as future credit.
